This page provides general guidance for preparation of IP Management Plans and lists various sample plans that can be used by extramural funding applicants to prepare intellectual property management plans when required by program announcements that cite this website as a resource. These sample plans are provided to assist applicants in preparing the intellectual property management plans in their partnerships with industry in order to meet certain programmatic objectives and goals of particular funding announcements.
The guidance and sample plans are not exclusive and should not be considered an exhaustive or comprehensive listing of acceptable approaches. Applicants are encouraged to use their own discretion to independently develop and submit their own plans for consideration. Applicants should confer with their institutions’ office(s) responsible for handling technology transfer related matters and/or sponsored research in the development of the intellectual property management plans. Applicants should obtain the concurrence of the collaborating institutions to the intellectual property management plans. If applicants or their representatives require additional guidance in preparing these plans, they are encouraged to contact the appropriate person(s) listed in the program announcements as well as to research and review approaches considered by other institutions. General Considerations - The approaches described here reflect a variety of mechanisms utilized by applicants to address the programmatic objectives of certain funding announcements for similar NIH programs.
IP Plan #1 - Sample letter that shows how Universities including co-investigators, consultants, and collaborators can describe a data and research tool sharing plan and procedures for exercising intellectual property rights. The letter is to be used as part of the University’s application.
IP Plan #2 - Sample agreement from a Medical School covering shared resources and datasets, and how any results will be disseminated.
IP Plan #3 - Sample Research Resources and Intellectual Property Plan for use by an Institution and its Collaborators for intellectual property protection strategies covering pre-existing intellectual property, agreements with commercial sources, privacy, and licensing.
IP Plan #4 - Sample letter from Research Institutes and their principal investigator and consultants, describing a data and research tool sharing plan and procedures for sharing data, research materials, and patent and licensing of intellectual property. This letter is designed to be included as part of an application.
IP Plan #5 - A sample Intellectual Property Management Plan in the form of a legal agreement between a University and its collaborators which addresses data sharing, sharing of research tools and resources and intellectual property management. The Plan includes: definitions; ownership information; details about oversight and management of the project’s intellectual property; information about patents; information about rights and licenses; and how disputes between the parties can be resolved.
IP Plan #6 -A sample Intellectual Property Management Plan which covers the objectives of the plan and a summary of how the issues are addressed in the plan.
Regardless of the strategy chosen for managing resulting intellectual property, the scope of the commercialization license should be commensurate with the research plan and relate to the proprietary product (drug, test, device, etc.) of the collaborator(s).
